This is a MAJOR PROBLEM with Toronto Real Estate Right Now

The pre-construction appraisal gap trap

A client recently shared about losing over $200,000 on a private mortgage he funded as an investment. I shared this video last week on FB after talking to him about it.


Then the video sparked more conversations with people and a friend DM'd me and said the same thing was happening to him. He was losing over $100,000 but in a pre-construction condo he bought.


One issue is a symptom, two issues are a pattern and patterns lead to ripple effects that last decades.


So...

If you or someone you know purchased a pre-construction property in the GTA over the last few years, please read this carefully.


Condo units bought and contracted at market peaks are now completing, but lowered market prices have created widespread appraisal shortfalls in money invested.


 Mortgage lenders finance against current appraised market values-not original purchase prices. If a unit appraised at $560,000 was bought for $750,000, the buyer must cover the entire shortfall in cash on closing day. (Can you believe it?)


The Danger of "Walking Away"


Walking away does not simply mean losing your 15%-20% deposit. In Ontario, deposit forfeiture is merely the floor of your liability:


 * Forfeited Deposits: Builders keep your initial funds.


 * Resale Shortfall Lawsuits: Builders have the legal right to relist the property and sue you for the full difference if it sells below your contract price. (CRAZY!)


 * Carrying Costs & Legal Fees: Courts regularly award builders daily carrying costs (taxes, interest, utilities), commissions, and substantial legal fees.


 * Personal Liability: Court judgments stay on your credit bureau for 6-7 years and can lead to wage garnishment or property liens.


So here's the Proactive Options Before Defaulting

Never email a builder stating you "cannot close"-this risks triggering an anticipatory breach and strips your negotiating leverage. Instead, act early to explore:


 * Extensions: Builders often grant 30- to 60-day extensions for a carrying fee, giving you crucial time to restructure.


 * Alternative Financing: Work with a broker to explore B-lenders, blanket mortgage programs, or private second mortgages to bridge the valuation gap.


 * Adding a Co-Purchaser: Combining incomes can help you satisfy lender debt service ratios. (Thank goodness!)


 * Vendor Take-Back (VTB) Mortgages: Some builders may offer a second mortgage behind primary financing to cover part of the gap. (Explore them.)


 * Close and Hold/Sell: Closing via bridge financing to either hold or immediately list the property avoids court judgments and puts you in control.


Key Lessons Learned From This Terrible Situation


 * Market Risk Sits with the Buyer: Standard agreements contain no automatic protections for falling market values; an appraisal gap is not a legal excuse to terminate.


 * Act 60 to 90 Days Out: Restructuring financing, arranging assignments, or negotiating terms requires weeks-leverage disappears on closing day. Be prepared!


 * Check Builder Compliance: Have a real estate lawyer review the file immediately. This delays violating the 'Tarion Statement of Critical Dates' or failures to provide statutory disclosure under the Condominium Act which can create legal grounds to recover deposits and avoid damages. (Thank goodness!)
