Tenant Rent Arrears & The new Eviction Process

As some of you may already know the ban on eviction through the courts is until the 20th of September 2020 and landlords will be able to issue claims on or after Monday the 21st of September.


The notice period for section 21 notice for England & Wales is now six months.


For section 8 notice the notice varies from 6 months to 2 weeks depending on the grounds and level of rent arrears.


Courts are likely to require landlords to provide information how COVID-19 has effected the tenant(s), all landlords should gather information, emails, notes so they can provide the court with the relevant information should it be required.


The BLA documents under the "Services" on our website has all the latest notices, template letters. To members, they are free to use.


If you already have an active case in the court, you are required to serve a re-activation notice on the tenant and file the same with the court. Failing to do so will result in the claim stayed until you re-activate it by serving the notice. 


You can obtain the activation notice from the court websites under forms.


All BLA members have free access to our landlord legal helpline on 01293 855700. We encourage all members to use this, should you have any doubt regarding what you need to do, to tackle rent arrears or other breaches.


As you can appreciate the courts and the bailiffs will be very busy, in our opinion, all possession claim should contain pleadings to use high court enforcement officers.


The benefit in doing so will potentially shave ten weeks off the eviction process and avoids having to make another application later, which will save you approximately £700 court and legal fees.
